Terms of Service

1. The service

AutoSwiper is a mobile application that aggregates public automotive listings from third-party websites and individual sellers and presents them in a swipe-based interface, along with tools such as saved lists, price-drop alerts, and market-price estimates. AutoSwiper does not own, sell, inspect, or take possession of any vehicle listed on the platform. All transactions, negotiations, communications, and agreements occur directly between you and the relevant seller. We are not a party to, and accept no responsibility for, any transaction.

2. Eligibility

You must be at least 18 years of age (or the age of majority in your jurisdiction) to use the App. By using the App, you represent and warrant that you meet this requirement and that the information you provide is accurate.

3. Your account

To use certain features (such as saving liked vehicles or receiving alerts), you may register using an email address or a third-party provider such as Apple or Google. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. Notify us promptly of any unauthorised use. You may delete your account at any time from within the App.

4. Listings & your content

If you create a listing or submit any content (photos, descriptions, specifications, contact details, or other materials — "User Content"), you represent and warrant that:

• you own or have the right to sell the vehicle and to post the content;
• the listing is accurate, lawful, and not misleading;
• your content does not infringe any third party's intellectual property, privacy, or other rights; and
• the listing is not fraudulent, deceptive, or for a prohibited item.

You retain ownership of your User Content. You grant AutoSwiper a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, display, and distribute your User Content for the purpose of operating and promoting the App. We may remove any listing or content that we reasonably believe violates these Terms or applicable law.

5. Third-party listings & external links

The App displays data, images, descriptions, and pricing sourced from external automotive platforms and individual dealers. We do not guarantee the accuracy, completeness, availability, or legality of any third-party listing. Listings and price information are updated periodically through automation, and structural changes on source websites may cause delays or discrepancies. The App contains direct links to original listings; we are not responsible for the content, products, privacy practices, or policies of any third-party website or seller.

6. Price estimates

AutoSwiper's market-price meter and valuation labels (e.g. "Great price", "Overpriced") are automated estimates provided for general informational purposes only. They are not appraisals, financial advice, or guarantees of value, and they may be inaccurate or out of date. You are solely responsible for evaluating any vehicle and its price before making a purchase decision.

7. Subscriptions & payments

The App offers an optional paid subscription ("AutoSwiper Pro"). Subscriptions are billed through, and managed by, the Apple App Store or Google Play, subject to their terms. Key points:

• Payment is charged to your Apple or Google account at confirmation of purchase.
• Subscriptions automatically renew at the then-current price unless cancelled at least 24 hours before the end of the current period.
• You can manage or cancel your subscription in your App Store or Google Play account settings.
• Refunds are handled by Apple or Google in accordance with their policies; we generally cannot issue refunds directly.
• We may change subscription pricing or features prospectively, with notice where required by law.

8. Advertising

The free version of the App is supported by advertising served through third-party networks, including Google AdMob. By using the free version, you acknowledge that ads will be displayed. A Pro subscription removes ads.

9. Acceptable use

You agree not to:

• reverse engineer, decompile, disrupt, overload, or attempt to gain unauthorised access to the App or its infrastructure;
• use bots, scrapers, or other automated means to extract user or vehicle data from the App;
• post false, fraudulent, infringing, or unlawful content;
• misrepresent your identity or impersonate any person or entity;
• use the App to harass, defraud, or harm others; or
• use the App in violation of any applicable law or regulation.

10. Intellectual property

The App, including its software, design, branding, logos, and content (excluding User Content and third-party listings), is owned by AutoSwiper and protected by intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the App for its intended purpose. You may not copy, modify, or create derivative works of the App except as permitted by law.

11. Disclaimers

The App is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or secure, or that any listing, price, or vehicle information is accurate or available.

12. Limitation of liability

To the maximum extent permitted by law, AutoSwiper and its creators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or in connection with your use of the App. This includes, without limitation, mechanical issues, fraudulent or inaccurate listings by sellers, financial losses from vehicle purchases, or discrepancies in advertised pricing. Nothing in these Terms excludes liability that cannot be excluded under applicable law, including your statutory consumer rights.

13. Indemnification

You agree to indemnify and hold harmless AutoSwiper and its creators from any claims, liabilities, damages, and expenses (including reasonable legal fees) arising out of your User Content, your use of the App, or your breach of these Terms or any applicable law.

14. Termination

You may stop using the App and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the App. Provisions that by their nature should survive termination (such as intellectual property, disclaimers, and limitation of liability) will survive.

15. Governing law

These Terms are governed by the laws of the Netherlands, without regard to its conflict-of-law rules, and any disputes shall be subject to the exclusive jurisdiction of the competent courts of the Netherlands, unless mandatory consumer protection laws in your country of residence provide otherwise.

16. Changes to these Terms

We may modify these Terms from time to time. We will update the "Last updated" date above and, for significant changes, notify you via an in-app notice or email. Your continued use of the App after changes take effect constitutes acceptance of the revised Terms.
